1. Agreement to Terms

By accessing or using SmartPlay ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

SmartPlay is a tool that provides analysis and recommendations for Fantasy Premier League (FPL) managers. The Service includes:

• Team analysis and player recommendations
• Transfer suggestions and captain picks
• Squad building tools
• Crowd insights from top FPL managers
• Machine learning-based predictions

3. No Affiliation with FPL

SmartPlay is an independent project and is not affiliated with, endorsed by, or connected to the official Fantasy Premier League, the Premier League, or any football clubs. All FPL data is obtained through publicly available APIs and sources.

4. No Gambling or Prize Contests

SmartPlay is an analytics and decision-support tool. We do not operate paid fantasy contests, accept wagers, provide betting odds, pool user funds, distribute cash or material prizes, or facilitate gambling activity. More detail is available in our Compliance Statement.

5. User Responsibilities

When using the Service, you agree to:

• Provide accurate information (such as your FPL Team ID)
• Use the Service for personal, non-commercial purposes only
• Not attempt to overload, hack, or disrupt the Service
• Not scrape or automatically collect data from the Service
• Comply with all applicable laws and regulations

6. Account Access

SmartPlay access is provided through a signed-in account. Each account can include up to 2 Fantasy Premier League Team IDs. The FPL ID identifies the team being analysed; it is not a password and does not grant access by itself. You are responsible for keeping your email and password secure.

7. Billing and Access

New accounts may receive a 10-day free trial with no card required. Trial access expires automatically unless paid access is purchased or another access arrangement is confirmed by support.

Paid SmartPlay plans are processed by PayPal as one-time payments for the stated access period. SmartPlay does not use recurring payments or automatic renewal for these plans. You can view PayPal receipts or billing details where available, or contact support if you need help. Access ends immediately for refunds, chargebacks, abuse, or payment failure where permitted by law.

Half Season customers may buy a one-time upgrade to Full Season access for the stated upgrade price. This upgrade is also a one-time payment and does not create a subscription or automatic renewal.

Unless a refund is required by applicable law or confirmed by support, payments are non-refundable once the paid access period begins.

To the maximum extent permitted by law, SmartPlay and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any decisions made based on the Service's recommendations
• Unauthorised access to your data
• Any interruption or cessation of the Service

10. Intellectual Property

The Service, including its design, features, and content (excluding FPL data), is owned by SmartPlay. You may not copy, modify, distribute, or create derivative works without our permission.

Fantasy Premier League, Premier League, and all related trademarks are property of their respective owners.

11. Service Availability

We strive to keep the Service available, but we do not guarantee uninterrupted access. The Service may be:

• Temporarily unavailable for maintenance
• Subject to modifications or discontinuation at any time
• Affected by the availability of third-party APIs (including the FPL API)

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the new terms.

14. Termination

We reserve the right to restrict or terminate your access to the Service at any time, for any reason, without notice.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
